Your friend can do whatever he/she wants.Hong Kong's courts will not act on any leases without stamp duty paid. So even the landlord wants to sue, the landlord will fail unless the stamp duty is paid.
Simply saying - both sides do not have the protection of the law.

前提，既然是朋友，就按朋友的方式去辦，沒有什麽也不存在什麽“可以”或者“不可以”，無非彼此設宴吃酒傾訴或留下一份人情在；否則就不是朋友或不打算再做朋友。
