有關簽訂租約時業主毀約

1, 業主簽臨約時,要求我出示入息證明,我話要後補比佢,冇咁快有!佢話冇問題並沒有提及何時要出示亦冇在臨約上寫明。到簽正約當日.業主冇準時應約到地產舖,AGENT致電時聲稱我提供唔到入息證明,唔黎簽約;並且依家話係我當日出示唔到,唔肯賠雙倍訂金!我可以告佢嗎?

2, 簽臨約當日,業主要我之後補返入息證明!咁後補既意思係有冇話默許或者行規係話幾時要補返?

3, 如果我真係告到小額錢債,到時如果個AGENT幫曬業主,我係咪基本上輸梗?

4, 個業主曾經經AGENT講明,如果簽正約當日出示唔到入息證明,就寫上去正約上面,但到當日佢反口!咁我又可以點呢??

5, 如果我告佢,真係敗訴既話!我會有咩損失?

其實業主要求租客提供入息證明係可以,租客提供與否亦係自由,而租客亦係可以要求業主提供屋契,或者係銀行既出租同意書,呢個係租客保障自己既權利,不過現況中唔覺有人會咁做(假設銀行收樓,租客係冇保障).

至於入息證明呢樣野,我個人認為唔係一個絕對關鍵,所以唔可能因為"遲交"而不履約,但講到打官司,永遠都係打過先知,因為打得就一定打細節位,你只係大約講左個情況.

1. 可以.係香港打官司係好平常.
2. 如果你正式簽約果陣已經預備好,我認為你比較合理.
3. 唔會,如果經紀講大話,仲可能間接幫左你.
4. 你只要堅信你所講既係事實就可以.
5. 只有金錢及時間上損失.

話時話,遲交可以不履約,咁如果簽約遲到,係咪又一樣可以咁做呢?

如果去報案話係行騙,首先要提供實際損失金額,似乎又唔覺有,因為對方只係唔賠訂.

1. No in most of the case.

It is difficult to tell if the time frame is reasonable or not. However, given that you actually did not provide any proof of income, it definitely does not look good on you.

2. No - it is based on your agreement. If there is no agreement, it is assumed that the information is available before the official lease is signed.

3. Let me put it this way - I don't see a reason why you can win this case. At the least, you fail to demonstrate any negligence by the landlord.

4. Unfortunately, all real estate transactions must be in writing. This is a perfect example of an exception to any verbal agreements.

你簽租約要入息證明? 未聽過,個人私隱噃,冇咁簡單俾人睇,如果要,咁你亦要業主屋契證明,至夠保障。

但佢係收咗錢,收咗錢就要守約,法律只是簡單的是與非,有做或冇做,沒有程度,你有單有據,應該有得打。
