Can my boss FORCE me to work while I am sick?

I have been ill for about four days now. It began last Thursday as a bad cold. I drug myself into work as I usually always work even if I'm on my death bed. I was noticeably suffering badly. Unfortunately, this cold has become more of a flu. I literally threw up (and I mean, really threw up...like not just a little bit) at my desk today and still have yet to break a fever despite taking acetaminophen. Other people at my office are starting to complain that they're getting sick themselves. I decided to take a personal day off to get into the doctor and get some medicine that will nip this thing in the bud...but my bosses response when I called in to call off was;

"This is unacceptable. We are going to be busy and we will need you. You have to come in. No excuses."


Mind you this is THE FIRST time I've called in sick AND he's physically seen me suffering. Can he tell me I still HAVE to come in? Can he even guilt trip me? How should I respond?

Your boss is a jerk. He can fire you for taking a sick day, however I would not go to work if I was throwing up. I would respond by saying, "I'm sorry that I am unable to work. I am sick with the flu and will not jeopardize my own health or the health of my coworkers by coming in to work. The flu is beyond my control and I need time to recover before I can return to work. My illness is not an excuse. I have been to the doctor and can provide a doctor's note if necessary."

Any employer who'd order you to come in to work even though you're sick, aught to have his business license revoked.

Tell your boss: being genuinely sick isn't an excuse, it's a fact and I have to take care of my health. And just don't go in if you are sick, period. If he says you "have to" come in, say "no, I HAVE TO take of my health and that comes first!.

You have a lousy boss. I suggest you call your doctor for an appointment, go to work, but LEAVE when it it time for your appointment with doctor, then afterwards come back with your doctors note. Granted, most employers don't have to honor the doctors note, but, if he fires you, this might help to file for unemployment.

IF, you have some virus that is contagious, and with the throwing up, fever, most likely it is, then, guess what, your other co workers will get sick also. If he is so busy and if the other workers get sick, what can he do then?

No they cant force you to go to work but they can terminate your employment due to some crappy reason that you were not able to fill your duties etc.. I'd talk to the human resources first, get a drs note to excuse you from work and then talk to a lawyer because what they are doing is not right and your boss should be held accountable. Just right everything down, the shifts you've coverd, when you were feeling sick, when you called in and were told to come to work or you would loose your job etc. so when you do talk to anyone you have facts in front of you not just, well I felt sick earlier and they told me to suck it up. Technically yes however if you go to the doctor and get a doctors note you should be covered. Most companies will leave you alone if you have a doctors note because there could be legal repercussions later if you work while sick and something happens to you. If they fire you when you have a doctors note for being sick then you do not want to work there anyways. Find a better place to work/better boss. Health comes first.
