急!!!媽咪鋪位比人拖租...

媽咪有一鋪位租比時裝鋪,月租3萬,租左1年,月頭1號交租!!!1年約完後,即上年5月我地和租客續租2年死約,租客一路亦準時交租...

但新年前租客話想唔做,我地話找到客頂租,我地只收一個月手續費...之前都正正常常,但上個月佢一路拖租,話無錢...
到2月14號只轉帳$12000,2月27號轉帳多$5000,到3月13號轉帳$11000,3次加埋得$28000,連2月份租都未交齊,我地可以點做???

P.S.合約寫明遅交要多收利息,我地係咪可以一併追討?去小額追定土地審裁署追?係咪可以收鋪??

追討過程幾錢,要幾耐,有咩手續?上網睇話報警無用,我地應該點做...打俾佢,佢愛理不理,話已盡量交租...

我要每個月去小額錢債審裁署追??因為再積落去金額會過$50000,另外佢有3個按金在我度,審裁署會唔會話有錢在我度唔受理??我又驚佢知我地告佢,佢發茅...

You should go straight to the Land Tribunal.

1. As soon as the payment is not in full (or in an agreed amount, like a minimum payment), it is a breach of contract.

Regardless how much the tenant has paid, you have enough legal basis to evict the tenant.

2. The Land Tribunal can dissolve the contract for you, as well as order the tenant to move out.

去小額錢債審裁署追討。不過她他有交租但未交足,有些難度。可向法院申請執達力封舖,再追討。

一件案只接受一次申請,你要考慮。按金如是合約規定不屬不接受範圍。怕他/她搗亂可向法廰申請執達力即時封舖減少損失。
