被地產告拖佣,求各位打救|||

-被地產入小額錢債告我拖佣-

之前已經和地產簽左臨時買賣合約
上律師樓先知間屋死過人

現在回想當初簽臨時合約,連樓契都沒俾過我睇

簽約前我俾左一萬蚊佣金,原本買得成的話,買賣雙方各俾二萬五。E家我決定唔買,地產就向小額錢債告我拖佢地一共五萬

想問@@
1. 呢種情況我應唔應該出庭?定係搵律師反追返佢一萬蚊?
2. 地產告我拖五萬的依據就係果份《物業臨時買賣合約》。上面有打「簽署人必須承受此合約之法律責任」。咁就代表份約有法律效力嗎?
3. 佢會告得入嗎/_\?

1. Appear and counter-sue.

2. Yes. The contract is the prima facie evidence showing that you have violated the terms of the contract. However, the issue is the agent misrepresented, resulting you severing from the contract.

In order to avoid a judgment against you, you must prove that with evidence:

a. Death has been involved in the property;

b. You are not informed until final phase of the transaction (any disclosures from the agency should be able to tell)

With that, you should be able to void the contract.

3. If you can prove the above, then no.

樓契業主按揭比銀行,是銀行抵押品,無論地產或業主要由律師行買賣時,要律帥行才可申請取回!

除非你在簽約前有問過是否凶宅,佢講大話,仲錄下對話,咁就有理據勝官司!

當時應在臨約上加上如果凶宅,買方有權無條件終止交易,及退回訂金!

條款無論那一方都有權加上!不接受唔買姐!

買樓前又係未做足功課!

你違約,或踼契,佣金照付,係行規,就算你通過第二代理成交同一單位,第一代理佣金仍要付。
