Overtime for commission workers only?

My mother works over 40 hours and makes her money off commissions only. Her current employer is Toyota and she works as a service writer. She just got her Tuesday's taken away now she works 6 days a week every other week. All together for her 6 day week, she works a total of 62 hours a week. She gets one day off one week and two days off the next, repeat.

I was wondering if she can get payed for her massive amount of overtime? They are very horrible there. Dress codes, their working conditions are off-putting, the management isn't open to ideas and do not care for their opinions.

Is there anyway my mother can get out of this besides getting a new job? Thank you!

Generally if someone is paid on a commission basis, the only requirement is that the employer must make sure that the commission paid equals at least minimum wage, and if it does not, they have to make up the difference.

For an example, lets assume you live in a state with a minimum wage of $8 per hour. In a 40 hour workweek, her commission would need to be $320. If she is working 62 hours, her commission would need to be $496. That is all before taxes, remember.

Not really. Better to have a job than be unemployed. Sometimes it is better to remain at a dead end job until your mother wins Lotto or can get a better job that pays a salary. That is all part of life.
I have had over dozen low paid blue collar positions in the 1980s and in the 1990s. Now, I am a middle aged man who is trying to get work as freelance writer.

she can't do anything if she is legally and correctly classified as 'salaried exempt'.
