死約到期,業主逼遷

本人簽了1年死約(2012-2013),1年生約(2013-2014)。通知期1月。
於本年12月滿1年,即死約到期。業主於死約到期前4個月通知不續約,由於到現時還未找到合適的地方,再因12月有些緊急事沒有時間搬。
剛打電話給業主商量拖後1個月,業主好堅決一定要我們在12月搬出,如不搬將會出律師信。

請問有什麼方法可幫到我,除了搬?
及請問通知期是不是在死約期滿後再可通知?

1. No. Legally, your contract only lasts for a year. See below:

That's why the landlord is in his/her full legal right not to renew and ask you to get out.

2. The only thing that the law requires is a proper notice. Since your landlord has given an extended time for the notice, as well as the landlord has not breach the contract, there is nothing you can do.

Simply saying - the landlord is right. You have to move. End of story.

同業主再相量,加租比佢,例如交三個月租,只住多一個月,並簽埋退租書,或者業主會通融給你住多一個月呢!

你之前份合約講明1年死約之後果年1個月通知即可, 個業主都提前左成4個月通知你搬, 我覺得個業主已經好通融架啦, 你話商量拖1個月, 俾係人情唔俾係道理, 你個業主提前4個月咁多通知你, 你都搬唔到, 冇得怪人架噃.

個業主態度咁強硬, 可能個業主將個單位賣左啦, 要交吉俾人, 你響度賴死唔走, 若果搞到個單位最後冇辦法成交, 個業主可以追討你, 要你賠, 多一事不如少一事, 拿拿臨搬吧啦.

你想拖多一個月,唔搬便可,業主申請收樓至執達利到達那一刻,頭尾要用兩個月...........

你可以買起業主間屋,既然你咁喜歡,你唔喜歡一早走咗啦,應該有得傾。
