租者置其屋(分户,分產問題)

本人80歲,現與幼子同住居者置其屋15年,我與幼子同是户主(屬長命契).幼子結婚10年有兩女,現5人同住.但未加入媳婦及兩孫的名字.
因家庭問題,我與幼子不想將來業權被媳婦瓜分.想問業權如何轉給另外兩子(一住居屋,一住公屋).
我想問
我百年歸老後,如幼子離婚,媳婦要分產;我有何方法做好保護資產的方法。

There is no simple way to do what you want to do - The joint tenancy will "automatically" transfer the title to your youngest son once you have deceased.

The good news is if the youngest son's wife want to get the property, it will not be a easy job as:

1. All inherited assets are excluded from divorce proceedings (even it is reportable);

2. The property was purchased before marriage.

Unless the wife can show that she has materially contributed to the property, the chance is not high. Even she has a chance to succeed, how many portions she can get depends on how much she contributed to the family.

If you do anything to break the joint tenancy, it may have a negative result. So if you want to insist on doing it, make sure you are fully advised by a lawyer before doing so.

現唯一方法是要您糼子將業權轉讓給您,便屬於您的物業,您媳婦是無權瓜分的,但轉讓就要花一筆律師費和政府的費用,所以您要先諮詢免費律師。

另是否要補地價才可以轉讓,都要諮詢房委會。
