Can an old driving ban on my criminal record cause problems with new employers?

I received confirmation of my interview success 4-5 weeks ago and I have still not been given a start date. I do not need to gove notice to my old employer as the company has gone into administration so I can start my new job asap. When I was notified they would be doing a CRB check on me I did not declare my previous driving ban as it was 5 years ago and I was under the impression it would not even be on my criminal record anymore. They have nw found out about it and saying due to the drink driving offence there is now a delay and they can't give me a start date. I dont understand how my old drink driving offence affects this job (it is not a driving job) and it was so long ago.

Can I just add to all of you saying I have lied - I have not lied as the offence has been "spent" therefore it was not necessary to declare it.

The ban itself is irrelevant. If you were sent to prison for the offence, it is spent after 10 years. If you were fined, it is spent after 5 years. Unless the post is exempt from the Rehabilitation of Offenders Act 1974, you are not required to disclose spent convictions.

Ask your potential employer what makes the post exempt from the Rehabilitation of Offenders Act 1974.

It is simply a double whammy.

You declare it before interview and whatever and risk being excluded for consideration or you do not mention it and then it comes to light later on and they wonder why you did not mention it and have second thoughts.

It is better to discuss it early on as a spent conviction rather than get in this muddle.

It is on your criminal record for the rest of your life the issue is if should
have been declared or not that will depend on the punishment given and the
type of job

A few things to point out here:

* A lot of employers have a policy about either not hiring people with a criminal record, or reviewing exactly what the record is before deciding whether or not to hire you. It's rare that a driving offence would be too much of a problem (in most cases at least), but the company policy might still require it to be reviewed.

* More importantly, you lied to them about not having a criminal record; not a smart move by any standards. That might affect their impression of you, even if the record itself isn't that big of a deal.

The problem may be with their insurers. there may be something in their general insurance conditions about employing anyone with a criminal record. Even if it's not a driving job, you might be required to travel about a little on their business. If you have done something positive to deal with any drinking problem you may have had, then you should inform them of this, as it would show a positive attitude. Perhaps you had better approach them to ask where you stand and how long you are likely to be kept waiting.

Your failure to disclose is the issue. I'll bet you do not get hired. You should have gotten a copy of your record before you decided to with hold info.

You lied and that is what is important, you are asked to write down all convictions, spent or otherwise and you chose not to do that and you were asked as you were told a D........... so they will do an enhanced check on you which will take more time, I am suprised they have not just pulled their offer of employment anyway as most companies would..it is not just about driving, if you are in contact with young people or vulerable people that too and it is a way companies can background check you and decide your honesty.............

Any offence especially one that wasn't declared is a problem, it depends on how strict the company is though but by what they have said I doubt that they will let you have the job sorry man :/

It is hard to say how long a court appearance will take. If the judge or prosecutor is late, then you are going to be all afternoon. Always plan that way, then you will be covered. If your case is delayed because of the one ahead of you going long, then same thing.... Always plan on the day being shot.... as for disposition? It is anyone's guess, but you have a lot going for you with a clean driving and criminal record. The fact that you are employed, and your employer has written a letter for you will likely go a long way in helping the magistrate adjudicate your situation. You made a serious mistake in judgement, and you have taken responsibility.... I don't think you need to worry too much.....
