你好：
有個問題想大家幫幫忙！本人姐姐不幸世逝，生前在美國買了一份人壽保險，受益人是我的兒子！姐姐收養了我的兒子，但收養紙上沒有姐夫名字，監護人是我的姐夫！在幾年前他們已離婚，但監護人仍然是我的姐夫，姐夫是否可以取筆保險金嗎？
備註：姐姐後來和姐夫又再一切，但沒有再結婚，已我和兒子依然與姐夫一切在美國生活！

The answer is no.The benefit belongs to your son. It is the end of the question.
The issue is if your son is a minor or not (below 18 years old).
If your son is a minor, his legal guardian can make certain arrangement with the insurance company on behalf of the child for the collection of benefits.
So at this moment, the most important thing is to make arrangement with the insurance company. Some companies in fact allows deferred benefits until 18 (while making interest at the same time).

如果受益人係寫左比你兒子的, 那賠償金就是賠比你兒子, 你姐夫是否能取到的, 除非你姐夫也是受益人之一....
