BB出世紙更改姓氏的手續

BB有2歲4個月..
父母已離婚..
BB跟MAMA~
MAMA想把BB跟自己的姓,
請問需要甚麼手續?
需要徵求父親的同意嗎?
需要甚麼文件? 這些文件到何處辦?
需時多久?
費用多少?
MAMA已為BB辦理回港證及回鄉卡,
需在更改姓氏後即時更改以上文件嗎?
可否待到期時才一併更改?

希望有經驗之人士解答,

1. You need a lawyer, as well as the father's approval.

A birth certificate, unless contains error, is permanent record that can't be changed.

So the only way to change the name is to use a name change deed by a lawyer.

For the cost and time, you will have to contact a lawyer.

2. No and Yes.

No - you are not required to do so as it is still valid (the name change deed will cover the new and old name. It does not void the old name at all).

Yes - it is for a better convenience.

1. There is only 1 Immigration Department. So if the Department asked you to ask a lawyer, find a lawyer. In your case, find another one.

2. Even without custody, the father is still a legal guardian for the baby (when necessary). So without his consent, you may end up with a big issue.
