房屋教易糾紛

關於房屋交易糾紛
房屋購買售價1400萬
由甲方出資300萬;乙方(我)出資1100萬(貸款)。而後由甲方出資50萬於房屋修膳。5年後賣出房屋2100萬,當初並無協議利益分配。想請問本個案於法院裁定金錢分配大約是如何?謝謝

數學題嘛﹗你出資1100萬,佔業權78.57%,出售後你應該得回相同比率收益,但1100萬是貸款你要支付利息,如果你要保持業權不變,利息無關甲方,同樣甲方出資修繕需要獨資才可保持21.43%權益,修繕費就與你無關,這樣子對甲方有利,因為當初賣房時還有50萬不知從何而出,你要好好想想﹗

There is no correct answer. The main reason is this question lacks of many crucial information:

1. No bank will approve the mortgage with that amount when all owners are not responible for it. Basically, it is unfair to approve this mortgage in all parties' interests.

2. Information regarding ownerships' distribution is missing.

Real estate transactions, unlike other transactions, must be in writing to be binding with the law. Given this situation, it is impossible that the information missing is not available.

Basically this question has no answer.

一般的商業合夥個案, 在沒有分配協議下, 損益是均分的。

2個人夾錢買樓又好,開間公司又好,如果冇寫明係點分配,一定係平分,亦唔會考慮中間邊個出幾多錢呢個問題.

你地當初以你描述呢個條件去"夾錢"買樓,而又冇定明權益分配,即係你2位都同意"在此條件下各佔50%".因為,其實好難去判斷邊個著數d,出錢既固然係出錢,但冇你又可能上唔到會;相反,你冇左佢可能又冇頭期資金,所以,打官司黎講,點會冇得打,你地要打律師都開心,但最好自己拆掂就算,始終大家都係贏錢.
