1. In theory, the U.S. can ban you for overstaying, which may impact your immigration petition (But in reality, due to humanitarian reason, this never enforces on immigrant visa petition). Also, you will be subject to stricter, non-random additional screening in the foreseeable future.

2. Your admissibility does not impact by your immigration petition. In fact, as soon as you can show intention to return (and be honest), the U.S. has no issue for you to come (and go).

3. A negative immigration record always haunts you. It is only a matter sooner or later.

我可否在辦理未婚夫∕妻簽證期間到美國旅行？

假如你打算在美國定居，你一定需要等待發出移民或未婚夫∕妻簽證，你不能以旅遊簽證或以豁免簽證計劃逗留美國來等候簽發移民或未婚夫∕妻簽證。不過，假如你想短暫旅遊，旅程完畢後會返回美國以外的永久居所，你可以用旅遊（B-2）簽證，或如果符合豁免簽證計劃，可免簽證入境美國。如果申請旅遊簽證，請凖備提供你會在旅程完畢後返回美國以外的永久居所的證據。雖然等候移民或未婚夫∕妻簽證申請未必確認你打算放棄在香港或澳門的永久居所，不過，領事在審查旅遊簽證申請時會考慮這個因素。當以簽證或豁免簽證計劃下免簽證到美國，你應該肯定攜帶美國以外的居留證明，假如在入境港口移民審查員不相信你是誠實的遊客，你可能被拒絕入境。
