2-3 pm shouldn't have noise restriction so far as i know. i used to practice trumpet in the afternoon and evening but none of my neighbours ever complained. if you use electric drum set, you can connect it to headphone so it won't make noise at all. but i would suggest you putting the electric drum set on a carpet, just in case of the noise made by the vibration.
i am not sure about the smoking problem, since it's a private area so technically he should be allowed to smoke. but if that affects your place a lot, you can tell the housing management of your building or estate and see if they can do something about it.
just make sure you don't play it too late at night and don't turn the volume too high.
