how can i keep feral cats out of my yard or what kind of legal action can i take?

I live in an apartment complex that has backyards. There are 8 feral cats that have cost me hundreds of dollars by tearing up my veggie/fruit garden and who also poop ALL over. I have tried all kinds of things to get rid of them...nothing works. I have even tried catching them in traps and taking them to shelters and the shelters are so full they refuse to take them, even to euthanize them (and that makes me so sad anyway!). I can't keep spending my money to rent the traps (I can only rent them for a few weeks before being charged more money) and these cats are too smart to get caught anyway.
I'm sick of smelling their poop, picking up their poop, seeing their poop. I'm sick of the cats completely tearing up my garden so that now I have no veggies or fruits to eat.

I have spoken with the apartment manager NUMEROUS times about this. I have spoken to the owner a few times as well. They tell me that they CAN'T do anything about it. The owner actually told me that he could get sued for trapping the animals to take to a shelter because it's "inhumane" (I explained to him that I know that isn't true, bu he doesn't care what I say). At this point, it's becoming extremely unsanitary. My child can't even go out and play in the yard anymore. Plus, I have no idea what kinds of diseases these cats may have.

Is there any legal action I can take against the owner of this building? I have done everything I can on MY end to keep these cats away or catch them and nothing is working for me. I don't believe that I should be forced to just deal with it...I believe the owner of the apartments should be responsible for keeping the grounds clean and sanitary.

The building owner does not own those cats, you can't take any more legal action against them for the cats as you can take action against me for them.

What do you want him to do anyway? Shoot them? Poison them? Since the shelters will not take them that leaves the owner with the same options you have.

Nothing you do will completely eliminate the existence of feral cats in your area. If you have them euthenized or relocated, it will simply create a vacuum and feral cats from elsewhere will move in. Any form of killing or relocation has been proven ineffective to control feral cat populations. It would be like trying to kill all the squirrels, it just wouldn't work.

The best thing you can do is stop them from breeding. Trap them, get them fixed (many places offer low-cost or free neutering for feral cats, and then "ear-tip" them to mark them) and release them back where you found them. This is the ONLY method of population control for feral cats that has been proven effective.

Feral cats don't live very long unless someone is feeding them (2 years max, and most die as kittens), so if you're vigilant about trapping and neutering, you'll see the population go down over time. There will still be some, of course, but those that remain will better be able to keep other feral cats away if there isn't such overpopulation.

I had/have the comparable situation. i offered the enormous length Hav-A-heart catch (approximately $35) and bait it with the main inexpensive canned catfood -approximately 25 cents a can. I set the catch out interior the night. If it capture a cat with a collar and tag, I take it to its homestead. If it does not have a collar, I drench it with the hose and permit it bypass. If they are feral and the complex owner is not feeding them you do not have anyone to take legal action against. Feral cats are a problem across the United States thanks to the jerks that get cats and then dump them. I am confused if you have actually caught them in the traps or not? If the SPCA will not take them call your township animal control officer. Every town has one. They will trap the cats if in fact there is problem with peeing and pooping or even just because they are not vaccinated. You can also google local cat rescue groups in your area. Usually they will trap them, have them fixed and release them into a feral colony somewhere else. You just need to research and make the calls.

If you really want to take legal action, talk to a lawyer, and bring a copy of your contract with you. He or she would be able to help you figure out if there is a loophole that you can use to make the landlord do something. I agree with you, I would not want feral cats in my backyard. I have heard that spreading cayanne (dont think thats spelled right) pepper around deters them, have you tried that? Feral cats can have all kinds of parasites and diseases, so please don't let your child play outside. This doesnt look like something that the owner can do too much about, but talk to a lawyer, they would be able to tell you what rights you have. Good luck! Oh, did you try calling animal control? maybe they could help?

This is gross, but cats are territorial and "mark" their territory with urine. I believe gardening and hardware stores sell urine from other animals which can spray around. The smell will deter the cats.
