業主違約,怎麼辦????急!!!!!!!!

我有個朋友的租約早幾個月已約滿,(而在之前傾續約同時,業主曾提出朋友可選擇他手上的另一物業,但朋友仍然選擇現時的單位)業主亦承諾續約3年並加了租,最錯就是朋友相信業主會跟他續約,所以沒有即時簽署文件,最近,已交了2個月的新租金,朋友要求業主簽新租約,但業主竟然反口說沒有答應續約,於是朋友提出一個月口頭和書面通知退租,但業主要求3個月通知,我朋友想知:

1. 業主可不可以在生約期間,不簽署任何續約文件下要求加租嗎?
2. 這樣是違法嗎?
3. 若是違法,朋友可以要求退還多付的租金嗎?
4. 在這種情況下,朋友要注意些什麼呢?
5. 在那裡可以尋求協助呢?

Basically, the previous lease has fulfilled, the owner can pretty much do whatever he/she wants until a "written" lease is signed again.

4. Your friend is mostly the loser in this case. The issue here is can your friend be able to leave in 1 month or 3 months.

In that case, the previous lease will tell which case it is.
