Salary vs Hourly? Which one is better?

I just got a job, my boss gives me this choose. He can offer me $18 per hour which means $37440 a year. And salary is $37440 a year. Would you choose hourly or salary? Which one looks more beneficial? Thanks

At 18 an hour that works out to 720 a week, and then times 52 that is 37440, which if you don't have over time that is great. But since bosses takes advantages of those on salary, I would take the hourly, so you get over time. If not they can work you more than 40 hours a week and not pay you. So do the hourly.

In this example (as a new hire) you should probably choose salary. As another poster said, it would be more stable. And despite what some people think, most salaried employees must also get paid for overtime. It all comes down to whether you are classified as "exempt" (does not get paid for overtime) or "nonexempt" (does get paid for overtime). In order to be exempt you normally would have to be in some type of management position with control over a department and other employees (among other requirements). So being a new hire, this probably wouldn't apply to you.

Just run... because the company has no clue about employment law.
Hourly (non exempt), Salary (exempt) is based on a federal law called the Fair Labor Standards Act.
You don't get to chose if you are hourly or salary. It's based on your job duties.
