Aforethought is an adjective. It means planned in advance: a malice aforethought. Forethought is a noun, and is the actual process of planning beforehand.

The first is the adjectival form of the noun.

eg Malice Aforethought.

"malice OF forethought" always sounded right to me and still does! The other way seems bizarre to me but I suppose if that is the term used by lawmakers ions ago then that is going to be held to as right. Sorry but it is wierd and better with the "of forethought" IMHO
