My husband and I have recently split, and we have 2 children ages 7 and 4. I have never work, so I have stayed at home with my children sense birth. My oldest is in school, my yongest starts in the fall. At the moment I have 0 income, he makes almost $50,000 a year. He has decided he wants to split time 50/50. Every other week he has them 3 days I have them 4. Then on the alternate weeks he has them 4 I have them 3. Will he still be court ordered to pay child support in nc?

If you have joint custody, time to get a job.

Nope since you each have them half the time. Hope you have a job now!

You need to book an appointment for a consultation with a family law lawyer to find this out. You also should get this separation/custody agreement prepared by a lawyer. Do not let your husband dictate to you what he plans to do without knowing your legal rights. It could very well be he isn't obligated to pay child support if you agree to 50/50 custody but it is a good thing for the children to spend as much time with him as you. Given you are no longer living as husband and wife I think you should do the smart thing and get a job and have money to support your children and yourself.

That's a question for your attorney...if the custody is going to be joint (50/50) the neither of you should have to pay support, but someone will be liable for health insurance and that type of thing (unless the cost of that is split as well)...

Nobody here can tell you what the court will decide...but it does seem time for you to acquire the skills to get a job to support yourself and your kids...even if he pays child support, that's not going to be enough to support you as well (nor is it intended to)...

probably not becuase its 50 50 but if you had them more time he would have to

He will definitely have to pay child support. You can fight the 50/50 custody too. That's not an ideal situation. He'll probably get e/o weekend.

You need to learn how to spell so you can teach your kids.
