What happens if a 17 year old guy has sex with a 13 year old girl?

Okay so my friend I know (she's 13) had sex with her 17 year old boyfriend of three months and she told her counselor and the counselor reported it to the police.

So yeah she is the one who suggested that they do it, and he agreed obviously, and now they're scared as to what will happen to them.

What are the laws in Australia/ what will they get???

Clearly a 17 year old guy having sex with a 13 year old girl has serious problems and deserves what he gets.

They will both get 14 years in a federal prison.

It doesn't matter if she suggested it. The legal age of consent in Australia is 16; so the guy is going to go to jail and will be marked as a child predator.

As for the other answerer; the counselor breaks that silence if a CHILD was hurt.

Depending on the laws in Australia where they live, the 17 year old can be charged with either statutory or child rape.

Age of consent is 16, in South Australia it's 17, in Queensland its also 16 but there is a special up the bum rule in which the age of consent is 18. Basically if you have sex with people under these ages it must be reported to the police. If someone has sex with a child between the ages of 10 and 14 then you can get 16 years in prison, but this will not happen to a 17 year old, they are more likely to just get into a bit of trouble and have to do community service or get detention or something but the chances of going to prison are unlikely. You can find the information under the crimes act section 66C

That must have been a crap counsellor, they are supposed to keep things confidential. Well, the guy could be put up for Statutory Rape, even though it was consensual from both parties, it is called that because of the age difference and the girl is under age to have sex.

For the 17 year old - he will be placed on the sex offenders registry that will follow him around for life - he would no longer be able to travel outside of Australia, teaching, police, the law, government positions are now out of bounds for him. Any job with children or access to children is no longer possible. This will reduce his earning capacity for life.
