樓宇維修 責任問題

We, each household of the whole building, shared the costs of doing a big all over maintanenace in the public area and the outside walls of the building.

The maintenance is not finished and is still going on, now the problem is due to their work in the pipe and the outside wall of the building, they damaged one of my window frame (not window glass). I am sure the damage is done by their constructing materials and chemicals.

Now my questions is, does the contractor have an irrevocable responsibility to fix the window frame for us?

What else can we do if the managment and the contractor is not willing to help us?

如果你有充份証據顯示,是由承辦商弄壞你家中的窗框,你係可以要求對方賠償。而對方亦都唔駛錢可以幫你整,因為對方做咁大型工程,一定要買工程保險,而工程保險亦一定包括第三者責任險,保額係絕對不少於港幣一千萬。

The contractor has the responsibility to fix the window frame for you. It is because they have the duty to preserve status quo during construction.

In case, unless you have an evidence to prove their constructing materials and chemicals damage your window frame, otherwise, nothing you can conduct.

If the managment and the contractor are not willing to help you or not willing to fix the problem, you may consider to write a demand letter for yourself or through the service of solicitors to deal with the above action.
