樓宇租約法律問題

如果同約客訂了兩年租約. 一年生一年死, 一年死的租約已經在今年 9/9/2011過了, 但個租客唔肯搬亦無意搬, 本人想收反自住.
本人在 16/9/2011 已出了律師信俾佢要求收回單位自住. 基於, 要一個月的通知期, 那麼一個月的屆滿係 9/11/2011. 或是由發信日起計.

All depends on the clauses and terms of the Lease Agreement. Commonly, by one full month written notice or you people have special agreements before. It is generally giving the tenant a few more day eg, 2 to 3 days for packup. 16/10/2011 onwards, the tenants have to move out.

There should be a date of moving-out and your repossession of the premises as stated in the letter issued by the solicitor after considering the reasonable time of notice to the tenant in accordance with the terms of the tenancy agreement. In case of doubt, as it is now under a legal issue,it is better for you to seek your solicitor for confirmation.
