假設本身在1月1日,但雙方同意下將合約日寫1月10日並雙方簽約,事後其中一方可否以1月10日的合約不是1月10日簽為理由而推翻???

It depends on the nature of the entire contract.However, simply based on this - no.
The reason is both sides agree to do this.
