One reason people are punished is so that they can repent. In other words, the motive of punishing them is to help them return to good and the punishment is an act of love. If sinners are given a death penalty, it might be unfair to them in that they will not given a chance to repent, which would also mean that they will be unable to re-establish a good reputation.
According to the Bible, sinners were often put to death under the Mosaic Law. However, God can judge whether one will repent or not. Although there exist people who will never repent today, we do not possess the ability and thus have no right to judge whether one will repent or not. Thus we have no right to end a sinner's life if there is still a chance for him/her to repent.
