代通知金 ++URGENT++

1. 代通知金只包括一個月基本人工還是包括佣金, OT津貼等等額外但不固定的收入?
2. Contract 要求"one month's written notice or payment". 法律上"PAYMENT" = "SALARY"嗎?


Contract:
Salary:
Your basic salary is HK$xxxx.- per month. Any allowance and incentive will accord to the prevailing scheme in force applicable to your position.

Termination:
Your employmen may be terminated by either party by giving one month's written notice or payment in lieu after the probationary period.

In contract of employment for termination as above, this means the contract could only be terminated with one month's notice e.g. letter of resignation given by employee or letter of termination given by employer. However, if this could not be performed, a current month's salary be given by party A to party B ( A or B could be the employer or employee ) as compensation for without giving a month's prior notice of termination to the other party.

1) 代通知金一般都是指月薪的, 而有關的佣金及津貼一般都很難計算, 因為造些都是按照個人表現來訂立的

2) payment係指你同雇主之間的合約, 有些雇主要求有關的員工賠償公司的損失
