長命契可否單獨一方做低押貸款?
有問題請教各位,
A 與B同在一物業中都是業主, 是長命契Joint Tenant,
請問 A 可否未得B 同意下, 到銀行OR財務公司做低押貸款 ? OR 出租物業呢 ?

如果物業持有人係屬於長命契性質的話,
任何有關該物業的一切動作,
都必須全部長命契名下業主一齊同意簽署才能運作,
否則一切無效。
其實所有與屋有關連,包括出租的租約、抵押、按揭、臨時及正式買賣合約,刀要有a及b的簽署,才有效!
When a property is pledged for any facilities, a legal charge must be done via Solicitor firm. The process is protected the Mortgagee on the return of the borrowings. In this regards, it is impossible for a Single party to apply the facilities without proceeding the Mortgage Deed.
However, nowaday, quite a lot of FIs (Financial Instituation) highlighted that they can grant the loan without proceeding the Mortgage Deed. Of course, they are on the discretionary basis. In deed, if the loan is deliquent, they would proceed the legal action on the recovery of loan via Small Claim or anything else if the amount is higher than HKD150,000.-.
