物業稅報稅---特急

物業是母子二人共同擁有,理論上業權是各佔50%,但報"物業租金收入"時,可否100%收入由母親報稅?因為母親是housewife,沒有其它收入,這樣可不用繳稅。請各位賜教,多謝!

it is impossible...no transfer is allow.

according to tax ordinance, the rental income is belong to each of owner by proportion of ownership.


for details, pls spend 1k to 2k to hire a accountant to get professional tax plan.....

租金收入係按照稅務條例嚟收,所以唔係你鍾意用邊個報就用邊個!凡事亦可能有例外,如果你能夠證明所有租金收入都係入母親個袋,包括租約及銀行記錄,稅務局可能接受。不過稅務局近年來非常進取亦不近人情,所以如果個官堅持唔俾就費事嘈,免得日後麻煩!

This is a simple fact and could not be planned by a professional accountant as stated. This is a law issue as clearly stated in the Inland Revenue Ordinance.

"可能接受" Not true. This is a matter of law on who is to be charged for tax purposes as well defined in the Inland Revenue Ordinance and not asking for how the rental income gone to.
