租約第二年, 生約期間, 業主可否隨時增加租金?

所謂生約,是在生效前沒有約朿,常見租約一年死一年生的意思是第二年合約相方只是一個意圖,只要有足夠通知,便可在生效前解約,業主亦可在第二年約開始前加租,你唔同意便可不執行第二年的約,但亦須之前合理通知,第二年約一旦生效後,便須按合約內容履行,沒有生死之分,如怕混淆,最好第二年約生效前換一張實約.

原則上係唔得,因法律上沒有生死約之分,你所簽既租約係兩年亦即係簽署既合約上所有條款都要執行兩年,而一般所謂既生死約意指退租權問題,一般依家簽既租約上都會有例明一方比另外一方最少一/兩個月書面通知或代通知金既,而發出呢個通知最少租客要住滿幾多個月咁,所以咁既情況下原則上業主係唔可以加你租,但實際上主可以先搵你同你講加租,約然你唔願意,業主就有權行使佢既退租權。

你不同意的話不可以加租,但業主有權1个月通知,把屋收回!

No. Only either party shall be entitled to terminate the tenancy agreement by serving a notice of such intention. The other terms of the tenancy remains unchanged and thus the rent should be the same for the remaining 1 year unless a new tenancy be mutually agreed and made in placement of this existing agreement.
