業主趕租客問題...急急急!
09年4月開始租, 租約期兩年,
我一直準時交租,
直到今年3月1日,
業主發sms給我說要收樓因想賣樓,
並要求我4月1日前搬出,
我說時間不夠,
她就隔兩天就打電話問我什麼時候搬出,
今天(3月9日)又留言說話最遲4月15日搬走,
話會發一封正式通知信給我,
我的租約期未完,
是否一定要搬走?

咁你要睇清楚份租約,因為有啲會寫發出退租通知係一個月有啲係兩個月,同埋要睇清楚發出退租通知係租客最少住滿幾多個月發出,因為有啲寫十一個月有啲係十二個月,因為呢度就係決定你洗唔洗一定搬走啦
因為如果寫十一個月加一個月通知即係你總共最少只可以住十二個月
但係如果寫十二個月加一個月通知就變相你最少可以住十三個月啦,咁如果十三個月你就未到期啦,咁就真係可以唔需要啋佢
You need to take a look at the contract you signed, as each and every contract could be different.
If you signed a 12+1 contract then she cannot give notice until the 12 months is up, that is she cannot give you notice until the end of March, and the earliest she can demand you to move out is the end of April.
If you signed a 2 yrs fixed leased then she has no right to ask you to leave until the lease is up.
純粹個人意見, 唔知 arm 唔 arm~~
你係09年4月起租, 理論上係未過死約期. 就算業主要一個月前通知叫你搬, 佢都要等到滿左死約期之後, ... 今日先至得3月頭, 佢無權趕你走的! i.e. 應該係由生約期 (即今年4月) 開始計之後一個月. am i right?
即是話, 你可以同業主講, 而家死約仲未滿, 滿左之後, 你搵到地方就會搬 (當然 "講", 可以係 "大隻講".....) 到時你唔搬, 佢都無你符.....
不過如果你夠惡, 可以一路住到整個租約期 (死約 + 生約) 都滿埋才搬走.
事實上, 我知有人會咁做~~
你的死約一年巳滿,在生約期內,业主只需一個月前通知,租客就要一個月后搬走,。
相反租客也可一個月前通知,不再租!
