There are no 洗底 or explunge of record in HK, all criminal record are there and final, your record can become spent overtime (3 years to be exact) that only mean you do not need to actively report that you have criminal record, not that your criminal record is gone. However, if the other part require you to produce CNCC or panel certificate, your criminal record will still be shown on such document.

If your criminal record is spent, you do not need to declare it, thus you do not break the law.

99.99999999% your visa will BE REFUSED. The other 0.00000001 % is that Case Officer is blinded or temporary insane that he/she may pass you your Character Requirment.

Drug Offence is Deemed a crime that hurt the community, No matter how small that is. This is an Automated Clause to refuse a visa, any visa application to Australia.

Your chances of even getting a Tourist visa is extremely small. Let alone a permanent Resident visa...

In australia, drug related offence is a crime that endanger australian society, it is pretty serious, no matter how big your crime actually was.

You can still apply CNCC (良民証) but in your CNCC, they will state the criminal record that you had, and how long you have been having.

如曾犯刑事罪行，而又符合以下條件，就可參加罪犯自新條例計劃：

1. 就該刑事罪行的判罰為不超過三個月的監禁，或不超過港幣一萬元的罰款；及

2. 以往未有觸犯任何刑事罪行而被定罪； 及

3. 被定罪後的三年內沒有再觸犯刑事罪行被定罪。

則可以不向外披露其刑事紀錄，以及該刑事紀錄不會成為他被排除於職位，專業，職業或受僱工作的合法或正當理由。

但罪犯自新條例只是讓犯事者在符合規定的情況下合法地不披露其刑事紀錄，而不代表其刑事紀錄被銷毀，刑事紀錄是不會被銷毀的，而是會永久存於警方及法庭的紀錄之中。

例如申請移民外國時，一定要出示無犯罪記錄證明(良民證)，雖然會列明沒有案底，但仍然會顯示申請人在警方的記錄。
