Is Luke 18:16 a fitting legal defense in cases of neglect leading to the death of an ailing child?

In 1944, the U.S. Supreme Court ruled that "the right to practice religion freely does not include liberty to expose the community or the child to communicable disease, or the latter to ill health or death." The court, however, did not expressly forbid the use of faith as a mitigating factor. Was it right for this matter to have been left to the states?
