遇上呃工傷員工

本人係小店老闆
最近請左個麻煩員工
事原.... 佢係sales, 係公司 sale緊野不慎跌親(係 chair度跌落地毯)
可能有少少事, 但點都不至於要幾十日假(由事發到今已一年多)
佢斷斷續續咁睇不同既醫生, 醫生每次開2-4日假比佢
但知道佢跟本無咩大碍, 仲成日去玩.... (從另一同事口中得知)
亦有幫其他公司做 part-time (我影左佢相)

佢其間有次帶埋親人上黎, 仲郁手打我 (已報警, 被告已認恐嚇罪)
諗住算啦, 唔追究傷人, 因為唔想煩, 亦知佢親人係被佢利用
點知幾個月後佢又去勞工處度告我, 話我掙佢人工(我出晒糧比佢架啦, 係佢有遲到早退果 d我扣返, 因佢經常嚴重遲到早退)
仲話我係工傷其間解僱佢, 要賠6千蚊比佢
聽日上庭啦, 我無解僱佢, 但公司己執 (因為經濟唔好, 加上知道工傷條例下, 小老闆係咁慘咁無助, 有d心灰意冷)
咁我公司執左又算唔算解僱佢?
佢係單傷人恐嚇勒索案後已無再比假紙我, 我亦知佢有係其他公司 part-time

上到庭應唔應該比錢同佢和解?
佢上兩手僱主都係要同佢上庭, 佢根本係職業騙徒

分明老屈啦, 下次最好一完工傷就fire!! 寧賠錢, 工傷其間法例係唔可離港和做其他job, (

The burden of proof is on you. You need to collect all the proofs and ask his previous employers to provide statements, if you can get them, and challenge him in court. Don’t be afraid. You can do it yourself.
