我想問如果我十年前因店舖盜竊而留有刑事案底﹝只被判罰見社工而且這件事後我已沒有犯任何事，故罪犯自新條例是適用的﹞，現在想用姻親關係申請移居台灣會不會不獲批准？

First of all Panel Certificate (CNCC - 良民証) is excluded from Spent Conviction Scheme (罪犯自新條例是不適用的) That mean when you apply CNCC, your criminal record will still show in your CNCC.

However, having Criminal Record will not necesarily affect your application of migration. Depends on the type of conviction and the period it had gone pass. You will still have high chance if that is all the record you got.

They will send one copy to you, another copy to ROC Authority.

When you fail to produce your CNCC, ROC authotiry wil lask you to attend an interview and you have to state why and what happened. WIll your husband family knows from this is another story, usually if your husband know and willing to keep a secret, it will be ok, otherwise, it will not.
