間屋滿約,點算呢?

本人住緊間屋仲有個半月左右就滿約,有D問題想請教各位教路:
1. 如果要續約的話要辦乜嘢手續架?
2. 應該我去搵業主吖?定係等業主搵我呢?
3. 乜嘢叫做厘印呢?有乜嘢用架?
4. 整續約手續駛唔駛錢架?
5. 最近既巿道又點呢?有冇機會叫業主減租呢?

1. some people will sign a new tenancy agreement, some people do not. But to protect you, I suggest you sign a new tenancy agreement and 去打厘印

2. I suggest you 去搵業主 so that if 業主 want you to leave, then you have more time to find a new flat. Also, if the 業主 raise the rental, you have more time to consider to stay or find a new flat.

3. 去打厘印 means after you and 業主 have signed the new agreement, then you guys can bring the agreement to HK Government to register. If anything happen and need to go to court, 打左厘印的 tenancy agreement is an official document and agreement. It is a way to protect both the tenant and 業主.

4. I remember 打厘印 of 2 sets of tenancy agreement is around $700, share, so ~HK$350 each.

5. 最近既巿道 not very bad, not like half an year ago, so, maybe it is a little bit hard to ask for rental decrease. Just try your best.

如果只得半個月就約滿, 業主好應該儘快聯絡你傾續約, 又還是安排交樓收匙等. 所以你應儘快CALL業主瞭解, 睇下佢會唔會租俾你, 除左租金問題, 業主亦有權唔租俾你, 只要有理由該單位作自用或親人居住, 又或者樓宇結構有問題需要進行維修.

通常傾妥租金都要簽署一式兩份既租約以確認相方身份及同意有關細節, 可以o係書局買到又或者業主自行準備tenancy agreement亦可, 之後業主應該將有關文件打厘印, 即係交印花稅, 此乃保障雙方, 日後有糾紛都可以攞出黎理論, 唔會話唔知份文件真偽, 因為相關政府部門已蓋印作實, 同時業主都要交form CR109俾差餉物業估價署, 以通知有關部門新的租金及有關資料等, 此乃保障業主, in case你唔交租, 如果業主無交過CR109, 法院將不受理業主追討欠租既申訴, 實際上, 你亦會收到1份副本.

續約除左俾厘印費(同業主share)外, 你可能需要俾按金差額如果加租既話, 當然減租就可以取回部分按金啦.

你可以嘗試叫業主減租, 不過最好你有留意附近一帶既租金情況會較好, 同埋你亦可順便提出住所上既問題, 有咩壞左都可以講埋, 睇下佢肯唔肯幫你維修嘛!

1. & 2 直接找業主講你想繼續租,傾妥條件就簽一份新租約。
3. 厘印即印花稅,政府稅收一種,打左厘印既租約在法律上被視為一有效文件。
4.業主租客自行簽定租約除打厘印外係無費用既
1-3年期租約厘印費 = 一年租金 x 0.5%,業主租客各付一半
5.議價還價,即管叫減租

1)同業主傾續約問題, 睇下業主是否繼續想租比你

2)如果業主想繼續租比你, 就講租金問題?? (加or減)

3)當大家同意時, 就去書局買2份"租約字"簽

4)打厘印就各自各負責比厘印費
