誰是租客??法律上問題

大家可唔可以幫幫手比d意見呀....最好答之前講埋比我知你識唔識法律上既野呀...thx你地先

問題...
1. 我想問我手頭上仲需要d咩...先可以追番d錢呀???要追..應該點追??
2. 勝算有幾高?

呢個係我同我前女朋友情況:
1. 3月租屋, 口頭協意每人交一個月租咁夜.......而我因為要借錢讀書..所以唔可以sign contract...連有定期過數付錢果d都唔得
2. 簽約前2,3個鐘, 我係ATM禁左錢比佢自己去sign contract
3. 我禁左$19500出黎. .... $500自己留番用....比左$1900佢去簽約
4. 簽約時要比第一個月租, 2個月按金 + commision + stamp = 約$1880
5. 4月...姐係租屋既第2個月...佢用atm交租
6. 5月....同佢分手...佢擺住間屋同看更講唔比我番上樓..
7. 分手後...已經搵過千次萬次..佢都唔應人..佢當我冇比租...佢自己住哂....即係佢only比左1個月既租費(第2個月)...就住4個月..


其他資料:
1.分手時佢問過我 : 你而家想點樣 如果唔繼續住我就同個業主講唔交租 住多兩個月就走(即住埋6月就走) + 會去搵屋搬
2.有sms, msn d 對話history....可以証明我係係果到住的
以下係佢對佢d frd既對話:
“”講真啦 佢走左之後我晚晚响屋企開party 只要好好利用間屋黎玩
比幾千蚊租我都拾得””
3.分手後.3個星期///.我不斷都有sms, msn , facebbok到叫佢出黎坐低傾下間屋既問題...亦因為我要保持番生活...咁就問佢囉番呢2個月既按金....但佢應都唔應...電話都唔聽...
4.分手後..佢唔比我上樓...仲用把鎖鎖住對門
5.水費是用我acc.過數的....家中tv stand係我acc過數買的
6.其他上網,煤氣係佢acc過數
7.其他的家私 係佢以前租屋果到搬過黎的

I will not say what is the chance you will win this. But you will have a case in the court.

Utility bills like water, electricity, phone do not necessary put you in a good spot that can argue you as the renter. But it still gives you a benefit of doubt by establishing a relationship with the agreement (usually utility will not allow third party's name on the account).

I will say file your case in Small Claim Court first. I don't really think that she wants to end up explain the court in entire matter. You should be able to get your money before the court date.

But really, file your case first and serve all summons accordingly. This will be your task for now.

我無讀過法律,但基本知識都會知。

老實講,你可以去"小額錢債"度追佢,不過勝算就不大,因為合約上名係佢簽嘅 (呢個喺法律上佢已經係租客),地產見到係佢俾租俾按金,無乜點見過你,除咗你哋嘅sms、msn等,咁仲有咩証明你係有份呢?你可以去報警,差人或者可以幫你,但一定要有足夠証據。

戶口過數嘅要盡快cut咗佢,如果佢自己要用就會再開

講真, 就算比你追到 都得不償失 (律師費高昂)
而且未必贏緊呢

所謂好來好去, 金錢上就無謂多作糾纏了
老友 下次帶眼識人吧

法律上 你女友才是承租人 (因為她負責與業主/agent 接洽)
你是很難追討的

你情我願 而已
