甘告唔告得入非禮罪

只要你真係無心，咁就唔構成非禮

刑事法有假定，要求被告有犯罪意圖才可定罪 (presumption of mens rea)。你無心既話，就無mens rea，就唔會有刑事責任

英國案例 Regina v. Court [1988] 2 WLR 1071 列明，非禮需符合三點：
1. 被告刻意對受害人作身體接觸
2. 客觀猥褻：該行為對一般人來說，屬猥褻
3. 主觀猥褻：被告刻意作出如此猥褻之行

系扶手上整衣服及袋時不小心掂左一位小姐既腳，符合唔到第1、3點，第2點都可以拗下，所以應該不構成非禮

當然，你必須要法官信納你的口供，如果你話自己無心但法官唔信，而控方能證明你有心，咁樣你都會被定罪。如果你點人地點左好耐都唔縮手，邊個會信你不小心 。

如果真係無心，第一堂就一定唔好認，亦唔好對差佬認，搵律師幫你。刑事案既舉證責任在控方，控方要入你罪要排除合理疑點，證明以上3點，有律師幫你唔會容易告得入。

Prosecution will rely on the witness statement, and the only witness will be the victim, the girl who complaint your touch. So virtually it will be your words against her. Normally the court should assume you are innocent, however, in real life, bias always put against the Defender.
therefore you better raise facts of the situation, for example is it a crowd place? you stand reaonably far away from the girl? your hand only touch the girl once when you tidying urself, you have not act strange at anytime. Also you can attack the girl's credibility, e.g. your hand touhed her or your clothes touched her, her statement match the scene description? she ID you? etc.

To the police, you better file a verbal assualt or harrasment against the one who swear at you, if he did actually yell, swear or act aggressively or oppressively, bear in mind the police probably be another prosecution witness act against you.
