有關租務問題,請各方高手出手指教
1)若租約已打印花,第三者可否循正常途徑,獲得有關租約全部或部份資料?

2)若不能,會有什麼其他方法可以佐証此租約存在?

3)如果業主與租客直接交易,但是他們否認有立任何租約,儘管地產代理與租客事前已簽睇樓紙,又能否向雙方追討佣金?

1: Yes.

土地註冊處為每項物業備存有一個電腦土地登記冊。

凡涉及物業的契約或其他文件遞交註冊,載於契約或文件內的詳情都登記在該物業的土地登記冊內。

文件辦妥註冊後,市民可繳交所需費用索取已註冊文件的土地登記冊及已註冊文件的影像副本。

3: Maybe. Don't forget the Law is equitable.

Even though there is no formal lease agreement between the landlord and the "tenant", the judge would consider whether there is a lease "relationship" between the landlord and the "tenant". Agreement needs not to be written contract. Of course the burden of proof would be on the property agent.

However, I think there is a high risk not to sign any agreement, just to avoid the commission (say a few thousand dollars). In case there is dispute between the landlord and tenant in the future, it is difficult to seek remedies through the court.

If there is no lease agreement, or if the lease agreement has not been stamped, the Landlord and Tenant (Consolidation) Ordiance can't apply

很難,唔係大公司好難chick...

你走去個單位睇下個租客係咪真係租左,再寄張信俾佢(下面回應左)

如果租客簽睇樓協議書後同業主直接交易可以向租客追討雙方佣金(包括租客及業主的佣金)根據租客簽定之睇樓協議書,即使係親友幫忙租成都需要俾地產代理佣金 如果你不肯遇到呢d事,可以一個星期寄一張通知書給租客及複印一張睇樓協議書俾佢,要求佢一星期內付清佣金(服務費),否則會向小額錢債審裁處申索,咪就得囉...一嚟又唔會得罪個業主,二嚟又可以解決問題...

1) 可以. 政府有一個部門是可以check到你的資料.

3) 理論上係追唔到佣金既. 因為不是賣買.
