Non EU married to a spanish citizen, getting the ILR?

Hello everyone, i am a moroccan citizen married to a spanish citizen since 2004, came to the uk on a tourist visa in 2003, i have been granted the 5years visa in feb 2006 due to him having trouble keeping a job, i have been told that i can only apply for ILR at the end of these 2years, however we would like to get divorced my solicitor said that i can apply for divorce and ILR because we have been living in the UK for 5years, i just want to double check this if its true and how long will all this process take, i am on y second year of paediatric nursing. thanks

all of these sorts of questions are very complicated. The rules do say that after 5yrs in UK, at least 3yrs marriage to an EU citizen, of which 1yr was together in UK, the person is currently working, you can be divorced and still apply for ILR.

You are right to go to a solicitor, you could also try one of the volutary sector immigration agencies such as Immigration Advisory Service, whoever you use make sure they are registered to give such advice.

i am the same situations as you but i am not studying at this moment. i have applied permanent resident cards for me and my 3 kids 2yrs ago. still waiting.......i need an answer fo this question too.
i know somebody just take 3months to get it done

you came in the UK in 2003,so you did not come to the UK as his dependent. so no? you do not need him to apply for your ILR . apply as soon as you can, as to the time that it will take? i cannot answer this.
