My brother married a thai, is it that easy to get a visa?

My brother is married to a thai lady in this country, her student visa is due to run out in the next 3 months. Does anyone know if she can automatically get to stay in this country on a spouse visa or will my brother have to move to thailand with her. They only married about a month ago, we have found out she was on a student visa but never went to college for the last 6 months, does this make her an illegal immigrant? They have filled in an Lrm form, If she cant stay my brother will move abroad,

If she failed to attend classes for 6 months, she is already out of status. The only option is get an immigration lawyer.

Your brothers wife is in a difficult position.How did they manage to marry without her obtaining a fiancee visa in Thailand? Legally she should of obtained entry clearance for this purpose before they married.
If she now applies for further leave to remain as a spouse she must make the application in Thailand at the British consulate..
Please be aware that the British immigration authorities are less than helpful in issuing visas even if all her documents are in order.( many people are refused a visa for no apparent reason ),and they should consult an immigration lawyer.
The cost of settlement is excess of £2.500 for various visas that will be required.Ie spouse visa, further leave to remain, life in the UK test and indefinite leave to remain.
If her current visa has not expired, then she is not an illegal immigrant, but she must return to Thailand under the conditions of her visa,to stand any chance of a spouse visa Application being successful.
If your brother is prepared to move abroad it may be the better option.

she's legal to stay in this country. she can be a british in 2yrs time. some might just take one yrs to become a british.

mycountry is canada and you could here stay and file for your spouse but if it usa i dunno the procedure you could keep her there but she may be illigal if it is the states
