My Fiance is on a Student Visa - Im British and Pregnant? ?

I have been with my Fiance for 2 years and he is in the UK with a Student Visa. I am British and also Pregnant.

We don't want to marry yet. we want to save. What is going to happen?
No-one seems to know..

Possibly he'll be able to residential status, but it is getting even more difficult. He needs to return to his country of origin and reapply.

Well i think it would be easier to just marry. this is no longer about immigration or you two as individuals. this is about a child and your future as a family. you've been together two years. sounds to me like its good. if the pair of you stick together you have more chances of working it all out. congratulations on the baby. i hope every thing turns out ok for you all.

He will not be allowed to stay in the UK unless he applies for and is successful in obtaining a fiancee visa from the british consulate in his own country.
Do not marry without obtaining this first, or the border and immigration service are likely to view any visa application for marriage as one of convenience based on financial reasons.
Your boyfriend must also return to his home country under the conditions of his current student visa, for any chance of future visa applications to be successful.
You must also budget for around £2500 for visa fees and expenses for successful visa applications ie fiancee visa, further leave to remain visa, and indefinite leave to remain visa.
Do be aware that many genuine applications for entry clearance are refused for no apparant reason.Entry clearance officers are less than helpful in issuing visas

Normally the best route is for her to return to her country, and then apply to come here on a fiance visa, valid for six months, for you to marry here. As soon as you have registered your mariage, she would apply for a two year extension, allowing her to work, and at the end of that period she would apply for Indefinite Leave to Reamin (assuming you are still together!). Alternatively, you could get married in her country, she could apply for a spouse visa, which is equivalent to the two-year extension - if granted she would be allowed to work immediately. Both visas require you to show that you can support and accommodate her without public support. It is not possible to marry here on her current visa unless you got a Certificate of Approval from the Home Office. These are not granted too often, and I think she would still have to apply for a visa to remain here. It is important that all steps are followed correctly - especially do not be tempted to overstay her visa. You should get legal advice, especially if you are thinking about the Certificate of Approval route. I would suggest that marriage abroad cuts out one of the application steps, each of which costs a few hundred pounds. The applications are normally processed in two/three months if there are no problems. I know you don't want to be separated, but this can actually be a good check to see if this is what you both realy want. And if you are planning to live here, it's only fair that you visit her family first, spend time as she has done immersed in another culture, etc. Go together to a Citizens Advice Bureau or immigration solicitor as soon as possible. you possibly could go into a defacto relationship with your marriage pending. set a date and call your consulate where your living and talk to them about it. in sure if you two are serious about your relationship they will let you start proceedings for you two to stay where you are and get married.

if you get marry then he will be able to grant the permanent resident card. if you don't get marry he might need to go back home when the visa is due.
there is nothing affect to your to be born baby.
