Under BO S.41(3), "Building works other than drainage works, ground investigation in the scheduled areas or site formation works not involving the structure of any building may be carried out in any building without application to or approval from the Building Authority. Provided that nothing in this subsection shall permit any building works to be carried out in contravention of any regulation."

For an A&A work which demolish the FR wall of kitchen in a domestic building (ie. turn a enclosed kitchen into an open kitchen in domestic building), although there is a requirement of FR wall of FRC for kitchen in domestic building in CoP, however, there is no such provision of FR wall for kitchen neither in BO nor B(P)R/B(C)R (ie. the 2HR FR wall and the seperation of Special Hazard and normal hazard occupancies). So strictly according to BO S.41(3), should it be exempted from the application to and approval from the BA?

Be careful, if you demolished the wall and finally found out it need BD submission, The works is considered “Retrospective” and according to PNAP 125, BD has no powers to give retrospective approval or consent to the works already commence, carried out or completed. The works should be reinstated to the satisfaction of BD and then reconstruct according the approval plan, although the works can finally be approved. So, please consult the AP/RSE before carry out the works.

BO S.41(3) is clearly stated that other than “the structure of any building”, no submission is required. To my understanding, Since the A&A work is within the building structure, if the element to be demolished is shown on the Approved Structural Plans, BD submission is required.

In case of if the wall not shown on the Approved Structural Plan and FSD approval plan, you may consider to demolish this. Furthermore, if the kitchen is located near to the escape route which will block the escape route in case of fire, don’t demolish this. If FSD carry out regular fire inspection, you will be in trouble.

Normally, Building Surveyor of BD will circulate the submission plan (General Arrangement Drawings and also FS Plan) to FSD for comment. You can call the drawing out in BD for inspection.
