In normal practice, the cheque should be issued to the order of the owner as shown in the Sales and Purchase Agreement / Assignment Deed. That money could also be drawn to the order of the solicitor's client account first and then the solicitor will issue a cheque for the same amount to the owner. Legal cost will be separately rendered and paid by the owner direct. For arranging cheque to be issued to a third party instead of the owner may means a separate legal service which may means an additional cost to the owner.
