厘印費及物業稅

如果出租物業在差餉物業估價署申報了是自住,而該物業的租約亦都沒有打厘印,那麼稅局會不會CHECK到我那個物業是出租的呢﹖

我都唔係好明…我都知ird要check實check到,但會唔會係好容易就比IRD CHECK到呢﹖而,如果我的租客都不用claimed back by the tenant to his employer for rent reimbursement,咁會唔會無咁易或少咗個機會查呢﹖ 可否再答﹖ 十萬個感謝

若你出租的物業是租比私人名義簽租約的,並且沒有打過厘印,
稅局跟本係好難查得出你已經將物業出租,除非有人去舉報你.
令外,若因為租約問題而要跟租客法律訴訟,你簽的租約仍然有效力,
你只須到稅局補回打該租約的厘印就可以,但當然要罰錢啦,
一般都係厘印費既幾倍,視乎過左幾耐未打.
但當你打左厘印後,你的物業出租狀況就會暴光的.

當你租了給租客, 你想想那租客報稅時,報那個地址, 而業主你報稅時又報那個地址, 如兩個不同, 已可查查, 而且現在電腦又快又聰明, 只需IT 部門寫個少少的程式便可.
故如不想交物業稅, 不如用有限公司持有.

Tax issue:
Apparently, IRD could check easily all properties owned by a person in one's own name. So, if you have more than 1 property, this may trigger an issue for the usage of other properties.
If the rent paid for that property is to be claimed back by the tenant to his employer for rent reimbursement, this maybe another issue that such information will passed to IRD.
Legal issue:
As the tenancy agreement is not stamped, you may have no right to recover any default rent from the tenant as the said agreement is not recognised as a legal document before the court.
