於2008年5月6日接獲閣下口頭通知, 將會終止貴司與本人之雇傭合約, 貴司會按合約規定給予本人1個月通知期, 唯此段期間, 本人若找到新工作, 貴司會容許本人提前離職, 而不需向貴司補償任何提前離職之代通知金, 而本人尚未放之年假, 貴司會以工資代替, 發放相等之工資給本人.

唯本人於2008年5月7日收到貴司之正式書面通知, 信中內容與閣下日前的口頭通知不盡相同, 按附上之貴司信件, 貴司會在通知期中扣除本人未於之大假, 即本人將不獲發相等未於大假之薪金. 經本人向香港勞工處查詢後, 知悉僱主及僱員均不可以將未於之大假在通知期中扣除,

請閣下確認本人是否可在通知期內提早離職而無需向貴司作出任何補償, 並同時會獲發本人未於大假之薪金, 以便本人作出適當之離職安排.

I refer to the verbal notice given by you on 6 May 2008 about the termination of my employment contract with your company. It was stated that your company would give me one-month advance notice, during which period I would be allow to leave employment if I could secure a new employment contract with another company. In that case, I would not be required to pay in-lieu-of any period of notice while your company would pay me the salaries for unused annual leave.
However, what is stated under the written notice issued on 7 May 2008 is not in line with that has been said verbally. According to the annex to the noice, my unused leave balance would be used to offset part of the notice period and thus no salaries for unused annul leave would be paid. Upon my enquiries, officers of the Labour Department advised that unused annual leave cannot be used to offset any period of notice.
To facilitate a smooth arrangement of the matter, I should be grateful if you would confirm your verbal notice if I could leave employment during the notice without being required to pay the company any payment in-lieu-of notice period, and the salaries for unused annual leave would be paid.

In May 6, 2008, I have received your one month verbally notification as per our employment agreement, my employment will be terminated after 1 month time.
But during this period, can you allow me to leave the Company if I got a new job ahead of the time, and could not compensate any leaves of job ahead of time payment in lieu of notice. As since I work with the Company, I have not yet to take any annual leave, the Company will prorata pay me of my wages.
In May 7, 2008, I only received the official written notification where has some difference in the letter the content and verbal notification. In your letter you expressed that you will deduct my annual leave days in lieu of notice time, and won't pay as my wages for my remaining annual leave.
After I consulted the Hong Kong Labour Department, and learnt both employer and employee may not deduct annual leave as the notice time.
Please advise if I leave the Company ahead of leave job and do not need pay any compensation to the Company, and will pay the wages for my annual leave. So that I can be able to make suitably leave job the arrangement.

As receiving from your announcement on 6th May, 2008, saying that your company will terminate the agreement made with me, your company shall follow the rules of agreement which giving me 1 month of notification period. If I have applied a new job in this period of time, your company should allow my early dismission and I do not have to pay any reimbursement. For the annual holidays which I did not take, your company should pay me money as equal to those holidays.
