I refer to the verbal notice given by you on 6 May 2008 about the termination of my employment contract with your company. It was stated that your company would give me one-month advance notice, during which period I would be allow to leave employment if I could secure a new employment contract with another company. In that case, I would not be required to pay in-lieu-of any period of notice while your company would pay me the salaries for unused annual leave.
However, what is stated under the written notice issued on 7 May 2008 is not in line with that has been said verbally. According to the annex to the noice, my unused leave balance would be used to offset part of the notice period and thus no salaries for unused annul leave would be paid. Upon my enquiries, officers of the Labour Department advised that unused annual leave cannot be used to offset any period of notice.
To facilitate a smooth arrangement of the matter, I should be grateful if you would confirm your verbal notice if I could leave employment during the notice without being required to pay the company any payment in-lieu-of notice period, and the salaries for unused annual leave would be paid.
