勞工相關法律問題,被老闆克扣佣金是否可以追訴。

我現在在一間大公司任職銷售人員(上市公司來的),合約列明我在代售公司產品毛利裏面抽取佣金20%,但有時會被公司借機會克扣佣金,佣金是否受到勞工條例裏面的保障,沒有證據是否可以向有關政府或法律部門尋求幫助。

例子:
我公司向生産商代理一產品為總代理,生産商產品市場定銷售價格為100元,給我方公司提貨底價為80元,我公司又同其它經銷商簽訂合同(合同是公司製定的)將貨品以85元賣給經銷商,我以銷售身份為公司尋找經銷商客戶及操作買賣,既是貨品80元來貨,85賣出給經銷商,公司在每件產品裏面賺取5元毛利。

但在操作完成之後,公司另外計算一筆數,就是產品賣給銷售人員的實際計算價格為90元,這是之前沒有講明的,而且所簽訂合約賣出產品定明是只准85元銷售,不准銷售人員作任何私自的改變,這樣變成銷售人員每賣出一件貨品就會虧損5元,虧損價格在銷售人員銷售其它產品盈利裏面扣除。

最近同公司雇員合約就快到期,不知道這樣的問題勞工署是否受理,另外法律追索期為多少時間(事件過去都3年了,不過一直沒有離職,也不敢同公司作對),我現時手頭上並沒有證據,是否有解決辦法,因爲公司不會將證據給銷售人員的,所有的只是公司同代理商簽訂合約副本,內部同銷售人員的賬單並沒有。所扣佣金應該有2萬元(我是指應該發放給我的佣金)。

You may want to know whether or not the commission rate is clearly stated on the employee contract. If the commission rate is clearly stated, then no doubt you have sufficient evident to sue or report the case.
Or else, you may want to consider one thing. How are you going to prove the commission rate? Certainly, commission offer by oral agreement at the time you were hired is a valid agreement, but how are you going to prove it if your employee denied it. Also, you have accepted the commissions for 3 consecutive years, which, by law you are accepting the rate employee offered to you. According to imply rule, if, for your case, the commission calculation and/or method is not mentioned or stated on the contract, then the historical payment offer and acceptance will be the contract binding calculation and/or method for your commission.
If you are able to grab more employees to stand up and report the case, then you still stand a chance to win it.
Surely employees rule and regulation do protect you from getting commission from employee. However, there is no limitation on how the commission is calculated.
