Renter evicted then broke in?
we evicted our renter and he left doing $6000 worth of damage. Then 3 days after we changed the locks he was seen breaking into the garage and then he broke into the house. We went to court this morning and nothing is going to be done about him breaking in. Is that right? Is there something we can do? He didn't even do jail time no fines nothing. So its ok for someone to break into others homes, because they won't do anything about it. Don't worry I'm not dumb enough to do it myself. So what if this guy owes back rent & money damages. I'm concerned that nothing is being done about him breaking in. I need advise. This went to COURT and they aren't doing anything. So please what can I do. Who's to say he won't come back and do it again.Any advice. I can't spend much because I already have to much rapped up in this.

Yes a police report was filed first and they even spoke with the neighbor who witnessed it.

The court basically said he is a 2 time loser and we won't get anything from him anyway. Fine but what about him breaking in? A police report was filed. He was just caught on the property again video taping a guy mowing the yard for us. And he had the nerve to tell the guy mowing that him being there mowing was illegal. What about the fact he was evicted 2 weeks ago and he shouldn't be there.

Your eyewitness should come forward to point the finger at the renter who was seen breaking into the garage and the house. Instead of going to court, you should have gone to the police first. Your eyewitness can file an affidavit with the police, this is usually enough to have the renter arrested. The court cannot do anything based on heresay (you did not actually see the renter broke into the house). It would be nice if you have video recording of the renter in the process of breaking into the house. Better yet, try to catch him in the act next time.

YOU NEED TO FILE FOR A CRIMINAL CASE. ARE YOU CURRENTLY IN CIVIL COURT. IF SO , FI LE CRIMINAL CHARGES. THE POLICE HAVE TO DO THIS BECAUSE IT'S THIER JOB. YOU CAN FILE B & E AND TRESPASS CHARGES.

What kind of court are you in? If criminal, you have breaking and entering, trespassing and vandalism. If it is civil, you can sue for the damages. Talk to a good attorney, I'm sure there is something that can nail the former tenant.
