樓契轉名...按歇都要轉嗎?

而家層樓是A君,用按歇的都是A君,但現在樓契想轉給B君,但按歇是否一定要轉埋俾B君呢???

通常律師行一般都會建議客人做以下文件
1.Memorandum of Sale/ Sale and Purchase Agreement (買賣合約)
 (賣方︰a;買方︰b)
2. Discharge (贖契)
 (借款人︰a)
3. Assignment (轉易契)
 (賣方︰a;買方︰b)
4. Mortgage (按揭契)
 (新借款人︰b)

因為要贖契才可轉名,所以一定還清按歇才可,若想繼續由A君供便要完成新契後重新申請過啦!

if you want to change the ownership of the property with an existing Mortgage, u need to release/discharge the existing Mortgage when the property change to another person. That means the older owner need to pay back all moneys to the Bank and the new owner would apply to a nw Mortgage from Bank with the new owner's name.
