關於美國綠卡己三年沒有到美國，又會於明年綠卡到期，請各位幫幫忙呀!

I've been working as a travel consultant for more than 7 yrs, as my experience, your husband's situation is kinda complicated.
First, why did he leave US for more than 6 months? It's because that US green card holder shouldn't leave the states for more than 6 months, the inspector in US Custom sure would have a word with you in a separate room.
If he got a reason for staying outside US more than 6 months, be sure to prepare for the questioning. An other thing might help is to apply for a Re-entry Permit, but that could take up to 3 months even you applied for express.
Your husband's green card is going to expire in April 2009, he could file a renewal 3 months in advance. Anything within 3 months to your expiring date will be accepted.

Hi according to US immigration law, greencard holder cannot leave US over 3 yrs, unless your husband has any special reason, e.g. working in US government outside US, US military/army .. etc., otherwise USCIS has the right to cancel your husband greencard. If he is lucky, custom officer will let him to enter US, then he can renew his greencard 90 days before the expiry date of his greencard. For my sugguestion, you are better to ask HK USCIS before going to USA. Do not take a risk. Good luck!

kind of confuse about your situation, how come your husband has green card and you and the son dont have it?
why in this 3 years, he did not apply you to immigret?

so, i can only straight answer your questions....
1. yes, the law said if he left USA over 1 year without return, he MAY lost his green card. it also depend his reason why not come back in 3 years...... it is all up to the customs officer buy the story or not. remember dont lie if they question his return, they have all the record by a click of computer key. if they find out you lie to them. that is the end of his green card.
***** unforturely, if they want to take his green card away. ( actually, they cant do it right there ), then your husband MUST ask for court hearing, so, he will got a court date but no matter what happen, he can go through the customs gate ......
US will not kick people back from the same airplane....etc, except that person have no any document with him.

2. if he is lucky to entry USA, of course he can file the extension for the green card.

3. what kind of visa your have?
make sure dont let the customs officer see you as his wife and use visa to come in USA....... more trouble and big mess will happen.

dont go ask the HK embassy or USCIS, they will give you a scarely answer and try to take his green card away in HK office. officers in HK think they are the KING.
so, it is better take a risk in the USA airport.

3年冇返過去..得2個可能性.. 1)即時遣返 or 2) 你入左境之後唔比再出返來..再出境就沒收你張綠卡 幾本上綠卡你要每半年入一次境..如果唔係佢有權收你張綠卡..而加你可以做既帶晒你起美國既
戶口,房產..反正全部關於美國既野都帶過佢比佢睇..睇下佢會唔會好人...比你用第2個方法啦.
