我係呢間公司做咗個半月, 家下想辭職, 我地係一星期返 5 日工. 放紅色假期.
因為我想last day係march 24, 08, 咁我可以攞埋個幾日既人工, 但係就只須要返到march 20,08.
根據下面既辭職要求, 想請問下七日通知係計唔計public holidays同埋星期日?
或提議辭職日期!

Either party may at any time during the first month of the Probationary Period terminate the employment without giving to the other party any notice but thereafter from the second month until the end of the Probationary Period, the employment can only be terminated by giving seven (7) days' written notice to the other party. After the Probationary Period, the employment can be terminated by serving one (1) month's written notice to the other party.

你還沒有過試用期呢！你寫辭職通知信是合約規定的,通知期內有公眾假期,依勞工法例來說是可以計算在通知期內的。
辭工後公司是有可能不給予你假日公資,原因是法例有規定要享有有薪假日是需要在假日前連續為僱主工作滿三個月才符合條件！所以依勞工法例來說,你是不能取得假日工資！另外關於休息日是否可以獲得薪金,勞工法例說要僱傭雙方協議。所以最壞情況下,你可能只能夠取得實際上班日數的工資！當然在最樂觀的情況下,公司有可能見你已工作接近一個月,就在離職時給你發月薪。勞工法例內容可在以下勞工處網站查閱,有需要時也可致電勞工處查詢。http://www.labour.gov.hk/public/pdf/wcp/ConciseGuide/04.pdf

建議較有爭拗的辭職日應該是試用期的最後一天。這天你是剛做滿一個月,你這份能有紅色字假期的工作一般都是計算月薪的。月薪工作的休息日是作有薪計算的。至於假日會不會被扣去薪金還得看公司是否大方了。

七日通知當然是計埋紅假期及星期日啦..
我以前做過好多份工, 都係咁樣計....
其實你可以問下你公司人事部都可以的....

根據勞工法例, 通知期係計 Calendar Days, 即不用上班的日子都計算在內。你3月18號遞信, 18號係第一日, 第7日就係24號, 25號開始唔駛返工。
