US Visa: J-1 visa

I am working at a trading company as a merchandiser for 10yrs, and there has a company who willing to employ me in New York. i just only hv F.5 standard. So how can i apply the working visa? I should apply H-1 or J-1? People said if i apply H-1, then i must hv degree. is it better for me to apply J-1 then?

照睇你應該申該申請係H-1B,除非請你果間係學校.H1唔一定要大學畢業.只要證明你有特殊技術而美國係請唔到.(例如酒樓嘅師傳,修車嘅枝工.佢地都唔會點可能大學畢業.)不過以你嘅職業,又唔似屬於技能!
唔知你而家人在美國或是在HK.如果在NY比較好辨.去唐人街揾個移民律師可能解答曬你嘅問題.而且第一次通常唔收錢.‥如果HK,就算揾到美國律師都收好貴.

You may consider H2 Visa. H1 visas are for "skilled labors". The position usually needs at least a bachelor's degree. H2 visas are for "seasonal and temporary labors". There is no need for a degree for H2 visas.

H2 visas, however , will let you stay for a maximum of one year.

No matter you're applying for H1 or H2, the petition process always starts with the employer. For H2, the employer needs to file a petition with the US Labor department. It can be a pretty complicated process. If your employer is willing to sponsor you with an "H" visa, they should start it quick. It takes months (sometimes more than a year) from the moment the process is started until you finally get a visa.
